Driver Terms and Conditions

Driver Terms & Conditions Effective Date: 29-04-2026

These Driver Terms & Conditions govern the relationship between EV Smart (“we,” “our,” or “platform”) and drivers who use the platform to provide transportation services.

By registering as a driver, you agree to these terms.

1. Nature of Relationship

• Drivers are independent service providers
• Drivers are not employees, agents, or partners of EV Smart
• EV Smart acts only as a technology platform connecting drivers with users

2. Driver Eligibility

Drivers must:

• Be at least 18 years of age
• Possess a valid driving license
• Have all required vehicle documents (RC, insurance, permits, etc.)
• Provide accurate and complete information during registration

3. Driver Responsibilities

Drivers agree to:

• Provide safe and professional service to users
• Reach pickup locations in a timely manner
• Follow all traffic laws and regulations
• Maintain vehicle cleanliness and condition
• Avoid cancelling rides unnecessarily

4. Conduct & Behavior

Drivers must not:

• Misbehave, harass, or abuse passengers
• Demand extra cash outside the app
• Refuse rides without valid reason
• Engage in illegal or unsafe activities

Violation may result in suspension or permanent removal.

5. Payments & Earnings

• Payments may be received via:

  • Online payments processed through Razorpay
  • Cash collected directly from users

• EV Smart may charge a commission or service fee (if applicable)

• Drivers are responsible for maintaining accurate payment records

6. Cancellations

• Drivers should avoid unnecessary cancellations

• Repeated cancellations may lead to:

  • Reduced visibility
  • Temporary suspension
  • Permanent removal from the platform

7. Ratings & Feedback

• Drivers may be rated by users
• Poor ratings or repeated complaints may result in action by EV Smart

8. Compliance with Laws

• Drivers must comply with all applicable local, state, and national laws
• Any legal violations are the sole responsibility of the driver

9. Liability

• Drivers are fully responsible for:

  • Their actions
  • Vehicle condition
  • Passenger safety during rides

• EV Smart is not liable for:

  • Accidents
  • Injuries
  • Damages caused during rides

10. Suspension / Termination

EV Smart reserves the right to:

• Suspend or terminate driver accounts for:

  • Policy violations
  • Fraudulent activity
  • Safety concerns

11. Changes to Terms

We may update these terms at any time. Continued use of the platform constitutes acceptance of the updated terms.
