Welcome to EV Smart (“we,” “our,” or “us”). These Terms & Conditions govern your use of the EV Smart mobile application and services.

By accessing or using EV Smart, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use this service
By using the app, you confirm that all information provided is accurate

2. Nature of Service

EV Smart is a technology platform that connects users with independent drivers for transportation services.

We do not provide transportation services directly
Drivers are independent service providers, not employees of EV Smart

3. User Responsibilities

As a user, you agree to:

Provide accurate pickup and drop details
Be present at the pickup location on time
Treat drivers respectfully
Not misuse the platform for illegal or fraudulent purposes

4. Booking & Ride Agreement

A booking is considered confirmed once a driver accepts the ride
You agree to pay the applicable fare for the ride
You are responsible for any additional charges incurred during the trip (tolls, waiting time, etc.)

5. Pricing & Payments

Fares are displayed within the app before confirming a ride (where applicable)
Payments can be made via:
- Online methods through Razorpay
- Cash (if available)
EV Smart is not responsible for:
- Payment failures due to third-party systems
- Incorrect payments made by users

6. Cancellations

Users may cancel rides subject to applicable cancellation charges
Drivers may also cancel rides due to valid reasons (e.g., location issues, emergencies)
Repeated cancellations may result in account restrictions

7. No-Show Policy

If a user fails to appear at the pickup location, the ride may be marked as a no-show
Applicable charges may be applied

8. Driver Conduct

While we strive to maintain quality:

EV Smart does not guarantee the behavior or actions of drivers
Users are encouraged to report misconduct

9. User Conduct

Users must not:

Harass or abuse drivers
Use the platform for unlawful activities
Provide false information
Attempt to bypass the platform for direct transactions with drivers

Violation may lead to account suspension or termination.

10. Limitation of Liability

EV Smart shall not be liable for:

Any accidents, injuries, or damages during rides
Delays due to traffic, weather, or unforeseen circumstances
Loss of personal belongings during trips
Actions or negligence of drivers

11. Service Availability

We do not guarantee ride availability at all times
Service may be affected by driver availability, demand, or technical issues

12. Account Suspension / Termination

We reserve the right to:

Suspend or terminate accounts for misuse, fraud, or violation of these Terms
Refuse service at our discretion

13. Changes to Terms

We may update these Terms from time to time. Continued use of the app constitutes acceptance of updated Terms.

14. Governing Law

These Terms shall be governed by the laws of India.
